Maui Beach Park Rules

County Parks are a shared public space. There are many different people wanting to use the parks for different purposes at the same time. The County have come up with rules that protect everyone’s right to use and enjoy the parks. Keep in mind the other users and try to make your minimum impact on the resources. Do not take up more room than you need, and do not block anyone’s access. This goes from parking thoughtfully, and where you place the gear. Take care that you are not blocking any pathways, or access to the beach, or along the beach.

13.04.040  General prohibitions applicable to all parks and recreation facilities.

A.   Within the limit of any park or within any recreational facility, it is unlawful for any person to:

1.   Abandon any vehicle or other personal property or leave any vehicle or other personal property unattended for a period in excess of twenty-four hours;

2.   Throw or dispose of any refuse or any waste material except in a receptacle designated for such;

3.   Permit any animal, except as hereinafter provided in subsection D of this section, to enter and to remain within the confines of any park area;

4.   Destroy, injure, deface, or remove in any manner any public structure, sign, equipment, monument, or device;

5.   Discharge firearms, air rifles, or spring guns, except at a range established and regulated for that specific purpose;

6.   Defecate or urinate on the grounds or improvements of any park or recreational facility, except in properly functioning toilets or urinals in public restrooms.

B.   Except as otherwise authorized by permit, license, lease or concession issued in accordance with the Maui County Code, it is unlawful for any person, within the limits of any park or recreational facility to:

1.   Distribute, post or place any commercial handbill or circular, notice or other advertising material;

2.   Wash, polish or repair cars or other vehicles;

3.   Store, repair, or condition any boat, canoe, raft or other vessel;

4.   Park or operate any vehicle on grassed and sand areas with the exception of a personal mobility device;

5.   Use or operate loudspeakers;

6.   Dance on any gymnasium floor;

7.   Engage in archery;

8.   Kindle, build, maintain or use any fire other than in a grill or hibachi;

9.   Consume any intoxicating liquor, as defined in section 281-1, Hawaii Revised Statutes, while within the boundaries of any park or recreational facility, if any boundary of that park or recreational facility is located within a one-thousand five hundred foot radius of any boundary of any public or private school or preschool, between the hours of six a.m. and five p.m., Mondays through Fridays, except state and County holidays;

10.   Consume any intoxicating liquor at any time in any public restroom;

11.   Consume any intoxicating liquor between the hours of eleven p.m. and six a.m. in any park or recreational facility, except civic and community centers, provided that this prohibition shall not apply to Molokai.

C.   The director may designate, by posting signs, areas where the following activities are not permitted:

1.   Throw, cast, roll, catch, kick, or strike any baseball, tennis ball, football, basketball, croquet ball, bowling ball, or golf ball;

2.   Ride on roller skates, skate boards, or bicycles.

D.   Regulation on Animals.

1.   The director is authorized to set aside areas within parks for horse riding, animal shows, dog parks, and dog obedience classes and trials.

2.   Dogs shall be permitted in all parks, provided that while outside the confines of a dog park, the dog shall be secured by a leash or lead of not more than six feet in length held by, or tied to, a responsible person at all times.

3.   The owner or handler of a dog shall not tie the dog to a solid object while in a County park.

4.   Dogs, except for guide, signal/hearing, and service dogs, as defined in section 6.05.010 of this code, are prohibited on athletic fields.

5.   While in any County park, including dog parks, the owner or handler of a dog shall be responsible for the actions of the dog.

6.   A dog deemed dangerous under chapter 6.04 of this code shall not be allowed in any dog park.

7.   The director shall adopt rules pertaining to dog parks.

E.   Regulation on motor vehicles. The director may prohibit or restrict the operation or parking of a motor vehicle within the premises of any park or the premises of a recreational facility.

F.   Any other use or activity not provided for under this article may be permitted in accordance with the terms of this chapter and the rules of the department.

Required Permits:
There is no commercial activity allowed in any County Park without a County Permit. Commercial Ocean recreation activities like surfing lessons need to have a CORA permit. CORA means Commercial Ocean Recreation Activity, and that means anyone teaching or doing an activity for any benefit. This is what the CORA permit looks like. It changes color each year. Permits must be displayed in the company’s vehicle, in the front window, at any time involved in an activity. Even if it is a private surfing lesson in the instructor’s own vehicle. The permit must be readily available for inspection by any park ranger, county officer or police officer at any time. COUNTY RULES FOR SCHOOLS: Please remember and follow these rules:

  1. All instructors shall provide proof of current CPR and first aid certification.
  2. No distribution or posting of commercial notices, advertising, signage or tents.
  3. No money transactions shall be permitted or performed in beach park.
  4. Keep all paperwork INSIDE the van.
  5. Loading and unloading of equipment must be completed within thirty minutes.
  6. Only equipment authorized by the permit shall be unloaded from a vehicle.
  7. All other equipment shall remain inside van or placed on top of the vehicle.
  8. The Windsurf trolley should be kept inside van or on beach (not on the grass.)
  9. No equipment may be displayed, stored, maintained, or repaired on County property.
  10. Do not leave spare boards or equipment outside of the van.

 

13.04.280  Permit conditions.

All permits shall be subject to the following conditions:

A.   The permit holder shall provide proof of current American Red Cross certification in cardiopulmonary resuscitation (CPR) and first aid, or equivalent certification;

B.   All transactions necessary to entitle a patron to engage in ocean recreational activity (including but not limited to selection of activities to be engaged in, selection of equipment, execution of rental agreements, payment for services, distribution or posting of commercial notices, advertising, signage or tents) shall be accomplished at the permit holder’s business location. No such transactions shall be permitted or performed in or on County property;

C.   In the event applicable rules designate an exclusive area in or on County property for unloading, rigging, assembly, and disassembly of the permit holder’s equipment, such activities shall be completed in that area and for no more than thirty minutes at a time; and

D.   Only equipment authorized by the permit shall be unloaded from a vehicle. All other equipment shall remain enclosed in or placed on top of the vehicle used to transport the equipment. No equipment may be displayed, stored, maintained, or repaired in or on County property.

E.   The permit holder shall:

1.   Name the County as an additional insured on the permit holder’s general liability insurance policy of at least $1,000,000, which insurance shall include a duty to defend the County if the County is sued as the result of the permit holder’s commercial ocean recreational activity. The insurance policy shall be issued by a provider that is acceptable to the County, as evaluated by standards established by applicable rules.

2.   Provide the County with a copy of the insurance policy in which the County is named as an additional insured; and

3.   Execute an indemnification agreement with the County covering any losses sustained as the result of the permit holder’s commercial ocean recreational activity, over and above those losses covered by the permit holder’s general liability insurance coverage.

F.   The permit holder shall submit an acceptable safety policy, as evaluated by standards established by applicable rules.

 

Restricted Parks

There are certain parks where surfing lessons are forbidden.

  • No Surfing Lessons at Hookipa Beach.
  • No Surfing Lessons at Baldwin Beach.
  • No Surfing Lessons at Cove Park.
  • No Surfing Lessons at Southern end of Kalama Park.
  • No Surfing Lessons at Kamaole Beach Park I.
  • No Surfing Lessons at Kamaole Beach Park II.
  • No Surfing Lessons at Kamaole Beach Park III.
  • No Surfing Lessons at Launiupoko Beach Park.
  • No Surfing Lessons at Puamana Beach Park.
13.04.256  Prohibitions.

Commercial ocean recreational activity is prohibited at Baldwin Beach Park, Cove Park, Hookipa Beach Park, Kamaole Beach Park I, Kamaole Beach Park II, Kamaole Beach Park III, the southern portion of Kalama Park (the section of Kalama Park from the sand beach at Cove Park to the southern most parking area adjacent to South Kihei Road), Launiupoko Beach Park, and Puamana Beach Park.

Permitted parks (with permit only)
There are certain parks where surfing lessons are permitted.

  • Surfing Lessons permitted at Kalama Park (northern end).
  • Surfing Lessons permitted at Kanaha Park.
  • Surfing Lessons permitted at Ukumehame Park.
  • Surfing Lessons permitted at (Front street) Armory Park.
  • Surfing Lessons permitted at Wailea Beach.
  • Surfing Lessons permitted at Waiehu Beach.

*please note that these beaches (except Kanaha) are not patrolled by lifeguards.

Kalama Park Restrictions

Kalama Park has strict rules regarding surfing schools.

  1. There are no lessons Sundays!
  2. No Vans in park after 2:00pm weekdays!
  3. There is no Surf School vans allowed in parking lot after 12:00noon Saturday
  4. No Lessons on certain Public holidays (check with office).
  5. Never any transactions on park property.
  6. Do not leave boards on grass when not in use.
  7. No Access via the “Cove”.
  8. Do not wash the boards with county water (showers/hoses etc).

Please learn & remember the restrictions, and always follow the rules.

 

Kanaha Beach Park

Kanaha Park has strict rules regarding CORA schools:

  1. Never any transactions on park property.
  2. Do not leave boards on grass when not in use.
  3. Stay out of designated swimming areas.
  4. Do not wash the boards with county water (showers/hoses etc).

Prohibited Holidays
No lessons can be taught on the following days;

Kanaha Beach Park:

  • January 1st, New Years Day
  • Last Monday of May, Memorial Day
  • 11th June, Kamehameha Day
  • 4th of July, Independence Day
  • 25th December, Christmas Day

 

Kalama Beach Park:

  • January 1st, New Years Day
  • Last Monday of May, Memorial Day
  • 11th June, Kamehameha Day
  • 4th of July, Independence Day
  • First Monday in September, Labor Day
  • 25th December,  Christmas Day
CORA PERMIT RULES

Money

No person/instructor shall engage in the solicitation of moneys, (which means no lessons can be paid for at the beach, all lessons must be booked thru the office. All paperwork must be done at the office or kept inside the van (no exceptions!). If a customer is at the beach and wants a lesson they MUST phone in their information to the office.

Certifications

All CORA instructors shall have a copy of their current CORA identification while engaging in CORA, (which means all instructors must have their OPACA card and a copy of their current first aid/CPR card on them).  I recommend keeping a copy in the van.

Equipment

All CORA equipment not being utilized must be stored in the operators vehicle, (which means DO NOT leave kites, surfboards, windsurfers or any school equipment on the beach, any equipment not being used must be de-rigged and stored back in the van).

CORA equipment shall not be dragged across grassy recreational surfaces and slopes within the county parks.

County showers and hose bibs shall not be utilized by CORA operators for cleaning vehicles or hosing off equipment, etc.

Permitted Hours of Operation

Kanaha Beach Park: 

  • Monday thru Friday    8am – 8pm
  • Saturday                   9am –  8pm
  • No Commercial Operation on Sundays

Kalama Beach Park:

  • Monday thru Friday   7am – 3:30pm
  • Saturday                   7am – 12pm
  • No Commercial Operation on Sundays
Special Restrictions by Park

Ka’a Point (Pro Beach):

No setting up, launching, landing or break down of kite equipment at Ka’a Point.

Old Man’s Beach (campground beach):

The setting up, launching, landing and break down of kite equipment shall be confined to the area of Kanaha fronting and west of the “Old Girl Scout pavilion”.

Instructor Rashguard:

CORA instructors must wear an article of clothing that identifies them as an instructor and their CORA business, (which means, you must wear your “Instructor” rash guard at all times while teaching).
